Terms and Conditions
These Terms and Conditions ("Terms") govern your access to and use of the DuraClean website (the "Service") operated by DuraClean ("us", "we", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service.
1. Accounts
1.1. Account Creation: When you create an account with us, you must provide accurate, complete, and current information. Providing false information is grounds for account termination. You are responsible for maintaining the confidentiality of your account password and for any activities or actions under your account. DuraClean will not be liable for any loss or damage arising from your failure to comply with this security obligation.
1.2. Security Breach: You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account. We reserve the right to investigate and take appropriate legal action, including but not limited to reporting to law enforcement authorities.
1.3. Account Termination: We reserve the right to terminate accounts, refuse service, or cancel orders at our sole discretion. Reasons for such termination include but are not limited to providing false information, breach of these Terms, or any fraudulent activity.
2. Purchases
2.1. Order Process: To make a purchase through the Service, you are required to provide certain information including, but not limited to, your name, address, and payment details. All orders must be paid in full before the warehouse will release goods.
2.2. Payment Terms: By completing a Purchase, you agree to pay the specified price for the product or service, including any applicable taxes and shipping fees. Payments must be made using the methods specified on our website.
2.3. Order Cancellation: We reserve the right to refuse or cancel your order at any time for reasons including but not limited to product or service availability, errors in the description or price, or any other reason. If we cancel your order after payment has been processed, we will issue a refund for the amount paid.
2.4. Final Sales and Returns: All sales are final. We do not accept returns or exchanges unless the product is defective or damaged. Defective or damaged products must be reported within 24 hours of receipt to info@duraclean.co.uk along with photos of the full extent of the damage across all items and the return must be authorised by us prior to shipping the item back.
3. Returns and Refunds
3.1. Restocking Fee: Any returns or refunds that are authorised due to defective or damaged products will attract a 25% restocking fee. The buyer is responsible for organising and covering the cost of return shipping. We will not accept returns that do not have prior authorisation.
3.2. Return Eligibility: Only items that are defective or damaged are eligible for return. Proof of purchase is required. Items must be returned in their original packaging and condition.
3.3. Refund Process: Refunds will be processed within 60 days of receiving the returned item, minus the restocking fee. Refunds will be issued using the original method of payment.
4. Product Information and Availability
4.1. Product Descriptions: We strive to ensure that product descriptions and images are accurate. However, we do not warrant that the product descriptions, images, or other content available on the Service are accurate, complete, reliable, current, or error-free. Any reliance on such information is at your own risk.
4.2. Packaging Variations: On occasion, the print colour of packaging may vary. These variations do not affect the quality or performance of the product and are not grounds for return or exchange.
4.3. Inventory: Product availability is subject to change without notice. We cannot guarantee that an item will be in stock. In the event a product is unavailable, we will notify you and offer an alternative or a full refund.
4.4. Backorders: In some cases, we may accept orders for out-of-stock items. These items will be shipped once they become available. We will provide an estimated restock date, but this is subject to change.
5. Intellectual Property
5.1. Ownership: The Service and its original content, features, and functionality are and will remain the exclusive property of DuraClean and its licensors. The Service is protected by copyright, trademark, and other laws of the United Kingdom and foreign countries. Any unauthorised use of the Service's content may violate copyright, trademark, and other laws.
5.2. Usage Restrictions: You may not reproduce, modify, distribute, display, or otherwise use any portion of the Service without the prior written consent of DuraClean. Requests for permission to use content should be directed to info@duraclean.co.uk.
5.3. User Contributions: If you submit any content, including but not limited to reviews, comments, or suggestions, you grant DuraClean a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.
6. Limitation of Liability
6.1. No Liability: In no event shall DuraClean, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorised access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
6.2. Force Majeure: DuraClean is not liable for any delays or failures in performance resulting from acts beyond our reasonable control, including acts of God, labour disputes, shortages of materials, transport difficulties, or government action.
6.3. Indemnification: You agree to indemnify, defend, and hold harmless DuraClean from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any intellectual property or other rights of any person or entity.
7. Governing Law
7.1. Jurisdiction: These Terms shall be governed and construed in accordance with the laws of the United Kingdom without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms shall be resolved in the courts of the United Kingdom.
8. Changes
8.1. Amendments: We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
8.2. Acceptance of Changes: By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
